(1) Appellant, Dewey L. Smallwood, Jr., pled guilty, pursuant to a written plea agreement, on October 17, 1988 to one count of trafficking in LSD. Several other charges against smallwood were dropped under the terms of the plea agreement. Smallwood was sentenced on December 12, 1988 to a mandatory term of three years imprisonment. More than two years thereafter, on January 19, 1991, Smallwood moved for post-conviction relief, and on March 12, 1991 the Superior Court summarily denied that motion. This appeal followed. The State has moved, under Supreme Court Rule 25(a), to affirm the judgment of the Superior Court on the ground that it is manifest on the face of appellants opening brief that the appeal is without merit.
